Luka Magnotta Faces First-degree Murder Charges

MONTREAL—A Quebec judge has ruled there is sufficient evidence for alleged killer Luka Magnotta to face first-degree murder charges in the slaying and dismemberment of Chinese exchange student Jun Lin.
Magnotta sat impassively and expressed no visible emotion when the ruling was delivered to a packed court room. He was dressed all in white and shackled at the wrists during the brief appearance.
The decision by Judge Lori-Renée Weitzman, handed down Friday afternoon, clears the way for a criminal trial that is not likely to proceed until early 2014.
Crown prosecutor Louis Bouthillier said he was “very satisfied” by the ruling and looking forward to the ultimate next phase of the legal process, which begins later this month and will end with a jury deciding Magnotta’s fate.
“I wish to salute the hard work done by the police officers in this case. They worked very hard and there’s still a lot of work to be done,” he told reporters in a brief statement.
Magnotta’s Toronto-based defence lawyer, Luc Leclair, had argued that the more appropriate charge against his client was second-degree murder, one that applies to unplanned killings, but the judge was not persuaded.
The reasons behind Leclair’s argument, as well as testimony that was heard by more than 30 Crown witnesses in the preliminary hearing phase of the judicial process, cannot be reported because of a publication ban on the evidence.
Magnotta, a one-time escort and gay porn actor, is alleged to have killed and dismembered Lin on May 25, 2012 and mailed some of his severed body parts to the headquarters of the federal Conservative and Liberal parties in Ottawa as well as two schools in Vancouver.
The victim’s torso was discovered in a suitcase that had been put out for garbage pick-up and his head was found in a Montreal park weeks after the slaying.
A gruesome video appeared on the Internet in the days after the killing that purported to show Lin bound and gagged on a bad and then brutally cut into pieces. The killing sparked an international manhunt for Magnotta, now 30, that eventually located him in a Berlin Internet cafe. He was reportedly trolling the web for news about himself when German police arrested him.
Scarborough-born Magnotta, whose birth name is Eric Clinton Newman, is also facing charges of publishing obscene material, criminal harassment, mailing obscene material and committing an indignity to a body.
Court documents released last week from a 2005 Ontario fraud charge involving Magnotta revealed that he had been diagnosed with paranoid schizophrenia and had been both hospitalized on several occasions and prescribed a regimen of prescription drugs.
A psychiatrist testified at the sentencing hearing that Magnotta’s symptoms included paranoia, auditory hallucinations and fear of the unknown.

Luka Magnotta was diagnosed with paranoid schizophrenia, psychiatrist’s letter reveals

Luka Rocco Magnotta  is a diagnosed paranoid schizophrenic with a history of not following his doctor’s orders, a newly released court document shows.
A 2005 letter from Magnotta’s psychiatrist, Thuraisamy Sooriabalan, says Magnotta was prone to paranoia, auditory hallucinations and fear of the unknown when he didn’t take his medication and make regular visits to the outpatient department at Rouge Valley Centenary Hospital in Scarborough.
Magnotta, 30, is accused of killing and dismembering 33-year-old Montreal student Jun Lin.
He’s having a preliminary hearing in Montreal to determine whether there’s enough evidence to proceed with his case.
The letter offers some of Magnotta’s mental health history and is part of public court documents relating to his 2005 conviction for fraud. At the time, Magnotta went by his birth name, Eric Clinton Newman.
The document was released Wednesday, after Judge Fergus O’Donnell quashed an attempt from Magnotta’s lawyer, Luc Leclair, to keep the public document private.
Magnotta has been suffering from paranoid schizophrenia since at least 2000, his doctor wrote. He’s been hospitalized because of it and had two stays at Rouge Valley Centenary Hospital in 2003.
In 2005, Magnotta was prescribed five different medications, including two antipsychotic drugs, Seroquel and Risperdal, to treat his disorder. He was also prescribed an anti-anxiety medication, a night sedative and a drug to counteract unwanted side-effects from his antipsychotic medication.
His treatment was also supposed to include visits to the outpatient department “for supportive psychotherapy and health education.”
Sooriabalan wrote that Magnotta’s prognosis was fair, so long as he took his antipsychotic medication and kept his medical appointments. But he didn’t always do that.
“Unfortunately, Mr. Newman is not very regular in attending the outpatient department and as a result he misses his medications,” Sooriabalan wrote.
Magnotta visited Sooriabalan on Feb. 25, 2005, and was instructed to return to see the doctor a month later “for continuation of medication and for reassessment of his mental state.”
He didn’t keep the appointment and still hadn’t gone to see his doctor by May 30, 2005, when the doctor wrote the letter. By then, Sooriabalan had been treating Magnotta for five years.
When he appeared in court in 2005, Judge Lauren Marshall warned Magnotta that he needed to take his medication as instructed or his life would “get messed up.”

Judge to deliberate whether Luka Magnotta sex-worker survey interview remains private

MONTREAL — A Quebec judge says she may look at the contents of a sealed interview with Luka Rocco Magnotta before deciding whether the Crown can have access to it.
Magnotta, who is facing a first-degree murder charge in the slaying of Chinese student Jun Lin last year, granted the interview as part of a 2007 study on sex-trade workers and their clients.
Authorities want a copy of the interview for evidence they’re still gathering against Magnotta.
A lawyer for the University of Ottawa academics who conducted the interview argues the material is covered by privilege as Magnotta was guaranteed confidentiality when he agreed to participate.
Superior Court Justice Sophie Bourque said today she’ll rule on the matter at a later date.
She says she is not ruling out looking at the contents of the interview and that she must balance the issue of privilege versus public interest.
Police became aware of the existence of the interview when a research assistant contacted them after seeing a news item about Magnotta’s arrest last year.
The Crown says it doesn’t know what’s in the interview, but wants the judge to have a look before deciding to quash a Montreal police warrant and giving the material back to the researchers.
The lawyer for the academics argued it’s unlikely the material would have much impact on a case involving charges for crimes allegedly committed five years after the interview.
He also urged Bourque to look at the material only if it is absolutely necessary.
A lawyer for Magnotta’s defence team supported the motion filed by the researchers to keep the interview confidential, but made it clear they will ask for a copy of it for themselves.
Magnotta’s preliminary hearing, which is to determine whether he’ll have to stand trial on the murder charge, resumes Monday.
Evidence presented at the hearing is subject to a publication ban.
Magnotta has pleaded not guilty to five charges and opted for a jury trial.

Belasah Ajelah

Aku dah pernah bilang, tak perlu sesiapa cari carikan jodoh untuk aku. Aku tak terdesak pun. Tak ada pun fikir aku ni bermasalah sebab masih tak berteman baru sampai sekarang.

Ada sebab. Ada sebab aku tolak. Ada sebab aku hindari. Aku belum bersedia. Dan rasanya diri sendiri pun aku belum mampu nak habis jaga lagi. Banggakan mak bapak pun belum lagi.Banyak lagi benda aku nak capai sebelum aku tambah tanggungjawab aku. 

Nak kata fobia?
Aku tak pasti. Tapi dalam bertahun yang aku kenal diri aku, aku rasa aku ni jenis manusia yang sanggup dan mampu tanggung risiko andai lah benda tu memang betul keinginan aku. Aku jenis rempuh aje kalau aku rasa  aku nak rempuh; takde nak fikir risau itu ini. Andai benda tu tak seelok yang aku sangka atau harapkan, aku anggap tu bukan rezeki aku. Dan dalam hubungan pulak, anggap dah tak ada jodoh. Aku tak jahil. Aku percaya kuasa Allah. 'Kun fa ya kun'. Semua Dia dah rancang. Semua dengan izin Dia.

Kalau ikutkan hati, memang dengan si Polan tu aku tak habis sayang, tak habis rindu lagi. Paling jujur dah ni. Tapi dalam masa yang sama, aku sedar punya lah banyak halangan untuk aku dengan dia. Kalau tadi aku ckp aku jenis main rempuh je kalau aku memang inginkan sesuatu tu, tapi dalam hal ni, memang aku ingin sangat dengan dia ni. Macam aku cakap la, sayang aku kat dia tak habis lagi. Tapi antara halangan halangan yang wujud antara aku dengan dia tu adalah orang orang yang jauh lebih penting. Yang aku lebih kena jaga. Itu sebab aku berhenti tengah jalan.
Dan kalau pun bukan sebab orang orang yang aku nak jaga ni, senang cerita, aku pun reti serik. Dan aku belajar untuk tak terlalu ikutkan perasaan sangat. Ye memang boleh je terus sayang dia, boleh je terus rindu dia. Tapi aku cuba sedaya aku untuk bataskan sampai situ sahaja. Biar cuma tinggal rasa rasa yang ada dalam hati aku. Yang hanya diri aku tahu. Yang hanya Allah tahu. Biar sampai situ sahaja.

Banyak benda dah jadi. Aku tahu dia pun sedar benda tu. Salah satu sebab yang buatkan kami berdua rasa macam dekat walaupun jauh, adalah disebabkan dengan hal hal yang kami dah tempuh sama sama. Suka, duka. Dari waktu kami berkawan, sampai la kami jadi lebih dari kawan.

Dan sampai sekarang, aku belum mampu bayangkan panggilan 'sayang' dari aku tu ditujukan pada orang lain selain dia. Sekarang, aku masih panggil dia 'sayang', tapi aku hanya mampu panggil dalam benak aku aje. Biar dia tak tahu. Biar dia percaya yang aku jahat, biar dia percaya yang aku tak pernah sayangkan dia.
